En este trabajo analizamos la aplicación e interpretación de la Convención sobre los Derechos del Niño – específicamente el principio del interés superior- en la jurisprudencia argentina sobre gestación por sustitución. A tal fin examinamos los fallos de distintos tribunales del país en la materia de 2013 a 2018 y damos cuenta que el principio del interés superior del niño consagrado en la normativa internacional ha sido uno de los principales argumentos para hacer lugar a una práctica que no está regulada en nuestro país Facultad de Derecho.
