description Difficulties in guaranteeing the supply of specific drugs for the treatment of human immunodeficiency virus / acquired immunodeficiency syndrome (HIV/AIDS) are recurrent given the advancement of adjustment policies. In Argentina, the gear that sustains compliance with public health obligations is permeable to crisis. The problem focuses on the most acute crisis in Argentina in December 2001, from Oszlak and O'Donnell´s perspective.  Objective: to reconstruct the processes of discussion, generation and implementation of public policies from the National Health Ministry —specifically in its interaction with international agencies— in order to guarantee the supply of antiretrovirals (ARV) to all people living with HIV/AIDS of the country. Qualitative approach, documents were used: four dossiers of the medication management of the National Health Ministry and minutes of Commissions. Semi-structured individual interviews were conducted with key actors according to their role during the health emergency. A category of the first dimension is presented: Strategies implemented by the State to guarantee the acquisition of ARV, category: international agencies. A data matrix was constructed to analyze the information. The reconstruction showed that the problem had an international agenda and that the commitments had to be fulfilled despite the crisis.  Tensions and contradictions are found within the framework of economic, social and cultural rights, taking into account the progressivity and non-regressivity of rights. States have double international pressure: agencies that monitor indicators rights and in the other side, lending agencies that define the priorities of recipient countries. Institutionally weak States, with low autonomy and in crisis generate programmatic vulnerability. Access to medicines is essential to achieve the right to health and it is a constant problem in emerging countries.

Las dificultades para garantizar el suministro de medicamentos específicos para el tratamiento del virus de inmunodeficiencia humana / síndrome de inmunodeficiencia adquirida (VIH/sida) son recurrentes ante el avance de políticas de ajuste. En Argentina, el engranaje que sostiene el cumplimiento de obligaciones en salud pública es permeable a las crisis. El problema se focaliza en el momento más agudo de la crisis de diciembre de 2001, y se trabajó desde la perspectiva de Oszlak y O´Donnell.  Objetivo: reconstruir los procesos de discusión, generación e implementación de políticas públicas desde el Ministerio de Salud de la Nación —específicamente en su vínculo con las agencias internacionales—, con el fin de garantizar el suministro de antirretrovirales (ARV) a todas las personas viviendo con VIH/sida del país. Con un abordaje cualitativo, se utilizaron cuatro expedientes de la gestión de medicamentos del Ministerio de Salud de la Nación, actas de comisiones y se realizaron entrevistas individuales semiestructuradas a actores clave según su rol durante la emergencia sanitaria. Se presenta una categoría de la primera dimensión: estrategias implementadas por el Estado para garantizar la adquisición de ARV, categoría agencias internacionales. Se construyó una matriz de datos para analizar la información. La reconstrucción muestra que la problemática tenía agenda internacional y que los compromisos debían cumplirse a pesar de la crisis.  En el marco de los derechos económicos, sociales y culturales, se encuentran tensiones y contradicciones, teniendo en cuenta la progresividad y no regresividad de los derechos. Los estados tienen doble presión internacional: organismos que monitorean indicadores de derechos y organismos de préstamo que definen en qué pueden gastar los países receptores. Los estados débiles institucionalmente, con baja autonomía y en crisis generan vulnerabilidad programática. El acceso a medicamentos es fundamental para alcanzar el derecho a la salud y es una problemática constante en países emergentes.
