El origen romano del derecho de prenda ex contractu, reside en la prenda judicial, puesto que aparece por primera vez en Roma, este derecho real, en la antigua legis actio per pignoris capionem, procedimieto judicial latu sensu. Veamos de cómo se llegó en aquél sistema jurídico paulatina-mente a esta concepción. Ante todo debemos establecer que toda institución jurídica carece de un valor absoluto, es decir, de un valor lógico verdadero para todo tiempo, ya que la parte abstracta, racional del derecho, se halla dirigida y predeterminada por la parte vital, histórica, que da origen a la formación y al estilo de las instituciones de pura lógica jurídica.
