En su libro Hauptprobleme der Staatsraechtslehre , Kelsen busca demostrar que el concepto psicológico de la voluntad no es aplicable a las ciencias normativas, sean éticas o jurídicas. Para estas ciencias -este es el resultado al cual él llega- la voluntad no es otra cosa que el "término de imputación normativa" que remonta hasta una persona y se detiene allí. Kelsen opina que con esta comprobación desaparece la controversia entre el determinismo y el indeterminismo, y establece incluso la hipótesis de que el concepto de la voluntad es originario de la esfera normativa, y que de éste ha sido transferido a la esfera explicativa de la psicología. Kelsen cree encontrar un apoyo para su hipótesis en la teoría psicológica "heterogénea" de la voluntad, según la cual la voluntad no es un elemento primordial de la vida mental, sino sólo un producto de otros factores psíquicos.
